Privacy Policy

The following statement describes the privacy policy relating to the products, services or websites, collectively referred to as the “Service” operated by Tikkl, Inc. (“Tikkl” or “we” or the “Company”). Tikkl collects information from individuals who visit Tikkl (“Visitors”), and individuals who register to use the Service as “Organizers” or “Customers” to run events, or “Consumers” to attend events or participate in promo campaigns, collectively referred to as “Users”. Your privacy is our top concern. We work hard to earn and keep your trust.

  • We do not rent or sell your personally identifiable information to third parties for marketing or advertising purposes.
  • We do not share your contact information with another User without your permission.
  • We do not share your customer database with anyone.

1. What Information we Collect

Non-Personally Identifiable Information

Non-personally identifiable information is information that, by itself, cannot be tracked to a specific individual. Tikkl may collect non-personally identifiable information while you are visiting Tikkl. While providing services and features, Tikkl may collect web surfing data such as your IP address, web pages on the web site that you have visited, time and date, the web site you came through to reach Tikkl, and whether or not you clicked on any links while at Tikkl. We may use different types of technologies to collect this information, including cookies and single-pixel GIFs.

If your browser is configured to accept cookies, these cookies will be used to recognize your computer when you revisit Tikkl to provide you with a better web surfing experience; for example, it allows us to learn how you use Tikkl and to show you information we think you would want to see. If you wish, you can configure your browser to block cookies; however, your ability to access certain portions of Tikkl may be affected.

Links to third parties may be displayed on Tikkl. If you choose to click on a link, Tikkl may provide non-personally identifiable information to the third party. Also, the third party may use cookies or other technologies to collect information when you are visiting their web sites. The information advertisers or other third parties collect is governed by their individual privacy policies, not by Tikkl's privacy policy.

Personally Identifiable Information

While providing various services or features, we may ask you to provide personal information. For example, if you choose to register at Tikkl, you may be asked to provide your name, email address, telephone number, company, title, password and/or username. If you choose to use Tikkl, create a profile or post information on features we may offer such as forums, blogs, on-line bulletin boards, or user community, you may elect to provide information, such as your name, telephone number, street address, age, text, messages, feedback, images, suggestions, icons, links to web sites, information regarding what products interest you, product information, bugs, and other comments, or other content (“User Submissions”).

2. Use of Information Collected

Use of Non-Personally Identifiable Information

Tikkl may use non-personally identifiable information collected to operate and improve the quality of Tikkl's services; for example, by diagnosing service or technology problems, by assessing and maintaining security, by increasing our ad placements on web sites that are generating more web traffic to us, by presenting you with information that we think you would be interested in seeing, or by allowing you to log in or access your profile information automatically. We may also use the information to count and recognize returning users.

We may use non-personally identifiable information collected to determine user demographics, interests, and behavior and may market Tikkl products by sharing non-personally identifiable information with potential customers or partners. Tikkl also may provide your non-personally identifiable information to contractors so that they can perform services for us.

###Use of Personally Identifiable Information Tikkl uses the information collected to perform the services requested. For example, if you fill out a “Contact me” web form, Tikkl will use the information provided to contact you about your interest in the Service. Tikkl uses credit card information solely to check the financial qualifications of prospective Customers and to collect payment for the Service.

User Submissions and profile information, including without limitation your username, email address, and location. may be viewable by others. Tikkl does not provide personally identifiable information to partners, except if you opt to provide personally identifiable information as part of an inquiry about products or services provided by one of the partners. In that case, we will provide that information to that partner so that they may attempt to provide you with information regarding the products or services about which you inquired. Tikkl may use the personally identifiable information provided by users for internal purposes, such as marketing, administration, or sending you email messages.

We may share personally identifiable information with third parties who provide Tikkl with administrative services and with reseller partners.

If Tikkl shares any of the information collected from you with a third party, the third party's use of that information will then be governed by the third party's privacy policy.

If you provide us your email address when requesting information or when signing up for user communities, newsletters, or other services, we may send you email messages to communicate with you or to provide you information that we think you would like to see.

If you provide personally identifiable information for your profile or other User Submissions, other users of Tikkl will have access to this information.

3. Other Sharing of Information

We may release any information about any user, including personally identifiable information, if in our sole discretion, release is appropriate to comply with the law, requests or orders from law enforcement, court order, or any investigation. We also may release information to protect our rights, property, or other interests, including those of our customers or users or to prevent illegal activities or violations of the Tikkl Terms of Service (available at tikkl.com/tos).

In the event that Tikkl, in whole or in part, establishes a partnership with another company, or is acquired by or merged with another company or enters bankruptcy, collected information may be transferred to the partner or the acquiring or merging company.

4. Notifications/Opt-out

It is Tikkl's policy to provide notifications, whether such notifications are required by law or are for marketing or other business related purposes, to users via email notice, written or hard copy notice, or through conspicuous posting of such notice on Tikkl, as determined by Tikkl in its sole discretion. Tikkl reserves the right to determine the form and means of providing notifications to our users, provided that you may opt out of certain means of notification. By providing Tikkl your email address you consent to our using the email address to send you notices, including among other things notices required by law, in lieu of postal mail. You may not opt out of certain service related product announcements. We may also use your email address to send you other messages, including changes to Tikkl features and special offers. If you do not want to receive such email messages, you may opt out by changing your account settings or by sending email to the following address: legal@tikkl.com. Opting out may prevent you from receiving email messages regarding updates, improvements, or special offers.

5. Promotional Emails from an Org

When you follow an Org, sign up for an Event, or participate in a Campaign, you consent to the Org using your email address to send you promotional emails, including among other things exclusive offers, event invitations, and contest announcements. If you do not want to receive such email messages, you may opt out by clicking the unsubscribe link in the emails.

6. Child Protection

Tikkl does not offer services to, or target, persons under the age of 13. In compliance with the Children's Online Privacy Protection Act, any information we receive from people we believe to be children under 13 will be purged from our database.

7. International Users

Tikkl is hosted in the United States. If you are accessing Tikkl from outside the United States, the laws or regulations governing personal data collection, use, and disclosure may differ from United States laws. Be advised that through your continued use of Tikkl, which is governed by U.S. law, this Privacy Policy, and our Terms of Service, you are transferring your personal information to the United States and you consent to that transfer.

8. Customer Data

Tikkl Customers use the Service to store and publish data and information (“Customer Data”). Tikkl will not review, share, distribute, or reference any such Customer Data except as provided in the Tikkl Terms of Service, or as may be required by law. Individual records of Customer Data may be viewed or accessed only for the purpose of resolving a problem, support issues, or suspected violation of the Tikkl Terms of Service, or as may be required by law.

9. Security

Tikkl uses robust security measures to protect Customer Data from unauthorized access, and maintain data accuracy. Tikkl's servers are hosted in a secure distributed server environment that uses firewalls and other advanced technology to prevent interference or access from outside intruders.

Tikkl provides each User with a unique user name and password that must be entered each time a User logs on. If you are the owner of an Org Account, you may grant, as well as revoke as necessary, Org Account admin rights and privileges to individual Users. Customers are responsible for maintaining the security and confidentiality of their Tikkl usernames and passwords as well as providing and maintaining the grant of Org Account admin rights and privileges to individual Users.

Tikkl issues a session “cookie” only to record encrypted authentication information for the duration of a specific session. The session “cookie” does not include the password of the user.

Tikkl uses industry leading SSL encryption to ensure that all communications between your web browser, our website; and between our web-site and credit card processing institution(s) is secure. Tikkl does not store any credit card information.

10. Compromise of Personal Information

In the event that personal information is compromised as a result of a breach of security, Tikkl will promptly notify those persons whose personal information has been compromised, in accordance with the notification procedures set forth in this privacy policy, or as otherwise required by applicable law.

11. Your Choices About your Information

You may, of course, decline to submit personally identifiable information through Tikkl, in which case Tikkl may not be able to provide certain services to you. You may update or correct your account information and email preferences at any time by signing in to your account. You can review and correct the information about you that Tikkl keeps on file by contacting us directly at legal@tikkl.com.

12. Links to Other Websites

Tikkl may contain links to other web sites. In addition, User Submissions might contain links to other web sites. Tikkl is not responsible for the privacy practices or the content of any third party web sites that may be linked to Tikkl.

13. California Privacy Rights

If you are a California resident, California Civil Code Section 1798.83 permits you to request information regarding the disclosure of your personal information by Tikkl to a third party for the third party’s direct marketing purposes. To make such a request, please contact us as set forth in Section 16 below.

14. EU General Data Protection Regulation (GDPR)

The GDPR requires Tikkl and Organizers using the Service to provide Users with more information about the processing of their Personal Data.

Legal Grounds for Processing your Personal Data

The GDPR requires us to tell you that the legal ground we’re relying on to process any Personal Data about you is typically because:

  • you provided your consent;
  • it is necessary for our contractual relationship;
  • the processing is necessary for us to comply with our legal or regulatory obligations; and/or
  • the processing is in our legitimate interest as an event organizing and ticketing platform (for example, to protect the security and integrity of our systems and to provide you with customer service, etc.).

Personal Data Retention

We retain your Personal Data for as long as necessary to provide you with our Services, or for other important purposes such as complying with legal obligations, resolving disputes, and enforcing our agreements.

If you have an account with us, we will typically retain your Personal Data for a period of ninety (90) days after you have requested that your account is closed or if it’s been inactive for seven (7) years.

Your Rights

Data protection law provides you with rights in respect of Personal Data that we hold about you, including the right to request a copy of the Personal Data, request that we rectify, restrict or delete your Personal Data, object to profiling and unsubscribe from marketing communications.

For the most part, you can exercise these rights by logging in and visiting the My Tikkl Page or changing the “cookie settings” in your browser. If you can’t find what you’re looking for in the My Tikkl Page, please contact us as set forth in Section 16 below. Please note that requests to exercise data protection rights will be assessed by us on a case-by-case basis. There may be circumstances where we are not legally required to comply with your request because of the laws in your jurisdiction or because of exemptions provided for in data protection legislation.

If you have a complaint about how we handle your Personal Data, please get in touch with us as set forth in Section 16 to explain. If you are not happy with how we have attempted to resolve your complaint, you may contact the relevant data protection authority.

Tikkl as a Data Controller and a Data Processor

EU data protection law makes a distinction between organizations that process Personal Data for their own purposes (known as “data controllers”) and organizations that process personal data on behalf of other organizations (known as “data processors”). If you have a question or complaint about how your Personal Data is handled, these should always be directed to the relevant data controller since they are the ones with primary responsibility for your Personal Data.

Tikkl may act as either a data controller or a data processor in respect to your Personal Data, depending on the circumstances.

For example, if you create an Org account with us to run events, Tikkl will be a data controller in respect to the Personal Data that you provide as part of your account. We will also be a data controller of the Personal Data that we have obtained about the use of the Tikkl Service, which could relate to Organizers or Consumers. We use this to conduct research and analysis to help better understand and serve Users of the Services as well as to improve our platform and provide you with more targeted recommendations about events and promo campaigns and partner opportunities we think may be of interest to you.

However, if you register for an event as a Consumer, we will process your Personal Data to help administer that event on behalf of the Organizer (for example, sending confirmation, promotional and feedback emails, processing payments, etc.) and to help the Organizer target, and understand the success of, their event and event planning (for example, providing event reports, using analytics to gain insights into the effectiveness of various marketing and sales channels, etc.). In these circumstances, Tikkl merely provides the “tools” for Organizers; Tikkl does not decide what Personal Data to request on registration questionnaire forms, nor is it responsible for the continued accuracy of any Personal Data provided. Any questions that you may have relating to your Personal Data and your rights under data protection law should therefore be directed to the Organizer as the data controller, not to Tikkl.

15. Modifications to this Privacy Policy

This privacy policy replaces any previous privacy policies formerly posted on Tikkl. We reserve the right to modify this privacy policy at any time by posting the changes on this web page and any such changes are immediately effective upon posting. Please check the effective date at the top of this page to determine if the privacy policy has been modified since you last reviewed it. Your continued use of Tikkl following posting of this or any updated privacy policy will constitute your acceptance.
